Kumersheran specialises in civil, commercial and general litigation, information and communications technology, intellectual property, insolvency and electronic discovery.

He has spent the last five years litigating, both in the High Court and in an arbitration tribunal, in the field of information technology and intellectual property law. During this time, he has been required to advise on and litigate a full spectrum of information technology matters such as:

  • Copyright infringement of source code of computer software programmes.
  • Reverse engineering of computer software programmes.
  • Emulation of computer software programmes.
  • Unlawful gap-analysis and benchmarking of computer software programmes (unlawful competition).
  • Utilising forensic computer software programmes to assist in discovery of large volumes of documentation (electronic and hard copy) relating to software development.
  • Discovery of electronically stored information (including source code of a computer software programme) as well as “computer evidence” in terms of the existing rules of discovery in South Africa and in terms of legislative and procedural trends overseas, specifically the Sedona Principles used in the United States and Canada.
