Practice notes

Tony is head of the firm’s insurance sector. He is primarily involved in insurance/reinsurance litigation. However, he also does work in connection with financial institutions litigation, forensics, healthcare, pharmaceutical and mining law.

Tony has been acting for insurers, reinsurers, underwriters, underwriting managers, insurance brokers and others in connection with insurance/reinsurance litigation since 1975.

He also has many years' experience in financial institutions litigation, where he has acted for banks, other financial institutions, the Banking Council, the Financial Services Board and the South African Reserve Bank.  

In the forensics field, Tony has handled some of the highest profile financial, commercial and white collar crime matters in South Africa on behalf of entities in the insurance/reinsurance field, Business Against Crime, the Banking Council, banks, the South African Reserve Bank, the Financial Services Board, the Pharmaceutical Manufacturers Association and others.

His recent experience includes:

  • Representing five South African and 14 overseas reinsurers in respect of a ZAR1.7 billion claim arising from a furnace explosion. The claim related to both property and business interruption, and is one of the largest of its kind ever in South Africa. The logistics of dealing with this matter were unique as a result of a number of reinsurers at various national and international locations and exceptionally large monetary amount involved.
  • Representing several underwriters at Lloyd's, as well as a South African insurer, in respect of the alleged misappropriation of pension fund surpluses. Tony had regular meetings in London with the representatives of the underwriters at Lloyd's to resolve the matter, which involved several claims, complicated legal issues and large sums of money.
  • Representing a South African captive insurer and, on behalf of that insurer, liaising and co-operating with the solicitors in London, representing the reinsurers. That included preparing witnesses and attending a lengthy trial in London in one of the commercial courts at the Royal Courts of Justice.
Tony is a director of the Arbitration Foundation of Southern Africa (AFSA).

He has been endorsed by Practical Law Company for Insurance and Dispute Resolution in 2009 and 2010.
