Lee specialises in commercial and general litigation, and medical aid law.
Her recent experience includes:
- Being on the team currently acting for the successful bidder in a tender dispute with a contract value in excess of ZAR200 million. The unsuccessful bidder is seeking to set aside the tender award by a local municipality to our client who is the successful bidder. The review application is still pending.
- Being on the forensics team that acted for one of the leading pension fund administrators in a ZAR1billion claim by the curator of various pension funds. The mandate included representing the pension fund administrator in the criminal prosecution by the NPA for alleged maladministration of pension monies. The civil claim was eventually settled and the criminal prosecution has since been resolved.
- Being part of the team that advised the leading pension fund administrator in the country on the constitutionality of section 332 of the Criminal Procedure Act, which seeks to impute criminal liability on a company for the acts of its employees/officials even when they are acting outside the course and scope of their employment.
- Being part of the team that successfully acted on behalf of one of the biggest commercial banks in the country in a ZAR187 million fraud scheme against a sophisticated fraud syndicate. The order granted by the North Gauteng High Court in favour of the bank is the first of its kind and many other banks that also fell victim to the same syndicate have imitated the approach taken by our legal team. The client has had a successful recovery rate.
- Being part of the team that was instrumental in brokering a deal with the regulator and one of the largest medical aid schemes in the country by means of mediation and methodical settlement negotiating.
- Being part of the team appealing a North Gauteng High Court judgment relating to the interpretation and effect of section 63 of the Medical Schemes Act dealing with the amalgamation of medical schemes and the Regulator's role in that process.
