Practice notes

Imraan heads up the firm’s employment law practice. He specialises in all areas of employment law and labour related litigation, ranging from issues as diverse as strike law and employee benefits to individual dismissals and advising executives on issues affecting their employment and directorships.

Imraan represents a range of employers in diverse business sectors and regularly appears on their behalf at the CCMA, the Labour Court and at internal disciplinary enquiries. In 2006 Imraan was seconded to Barclays Bank in advising on certain aspects of SA employment law relating to the transaction with ABSA.

His recent experience includes:

  • Obtaining an interdict against striking employees for the SA Post Office in a national strike that lasted three weeks. In its ruling the Labour Court re-emphasised the principle of majoritarianism in the context of collective bargaining.

  • Obtaining an interdict on behalf of Tyco’s operating entity ADT in a dispute where the SA Transport Allied Workers Union (SATAWU) had organised a picket to present and hand over a memorandum to ADT. The matter was before the Labour Appeal Court to determine whether the interdict impinges, as alleged by the union, the section 17 constitutional right to assemble, demonstrate, picket and present petitions. The appeal was dismissed in May 2011 by the Labour Appeal Court.

Imraan publishes regularly in various legal journals and in a number of newspapers and current business affair magazines on contemporary labour law issues. He also presents regularly at conferences on topics related to employment law.

Imraan has also acted as judge in the Labour Court.
