Introduction

Medical negligence occurs when a health service provider (such as a hospital, doctor, dentist, pharmacist) provides treatment that is below an acceptable standard, or unsuccessful treatment that goes beyond a reasonable mistake.

Negligent treatment may involve the following:

  • Failure to diagnose a condition, provide appropriate treatment, perform surgery or provide post-operative care with reasonable care and skill.
  • Delay in diagnosing a condition or in providing appropriate treatment or a referral for a condition.
  • Incorrect reporting on test results.
The law allows a person to claim compensation from a health service provider, if they have suffered physical, psychological or financial harm as a result of negligent medical treatment. This is known as a medical negligence claim.
